A car accident claim needs more than an estimate.
After a collision, an insurer may be ready to discuss money before you have a clear picture of your injuries. A repair estimate addresses the vehicle. An injury claim requires a different analysis: what happened to you, what treatment is needed, how work and daily life have changed, and what evidence supports those losses.
Avi Cohen represents car accident clients throughout Texas through The Injury Plug Attorneys PLLC. His approach starts with the details and prepares the case with trial in mind.
What Avi looks at.
- The collision: the crash report, photographs, witness information, and any available video.
- The injury: medical records, treatment recommendations, symptoms, and recovery.
- The losses: time away from work, out-of-pocket expenses, and the effect on ordinary activities.
- The coverage: which policies may apply and what the insurer is accepting, disputing, or requesting.
No single document answers every question. The purpose is to connect the evidence into a clear account of both responsibility and harm.
When the insurer says you share the blame.
An adjuster’s allegation is a position to examine. Under Texas’s proportionate-responsibility rules, a claimant generally cannot recover when their responsibility is greater than 50 percent; otherwise, their percentage of responsibility reduces recoverable damages. Whether those rules apply and how fault is allocated depend on the case. Read Texas Civil Practice and Remedies Code Chapter 33.
What to bring to a consultation.
Keep the claim number, written communications, photographs, treatment information, and any proposed settlement or release. You do not need every record before reaching out. If there is a deadline in a letter or email, include it.
Have an offer already? Or has an adjuster requested a recorded statement? Those are useful issues to raise in the first conversation.
